The United States of America, acting through the Millennium Challenge Corporation (“MCC”) and the Government of Benin (the “Government”) signed on December 14, 2022 in Washington DC a Compact for a program pursuant to which MCC agreed to provide a grant of up to two hundred two million dollars ($ 202,000,000) (« MCC Funds ») to the Government, as well as a two hundred three million nine  hundred fifty one thousand and four hundred forty six dollars ($203,951,446 ) contribution from the Government, to facilitate development of a Compact Program to reduce poverty through economic growth in Benin (« The Compact »). The Government, acting through Millennium Challenge Account-Benin Regional (“MCA Entity” or the “Purchaser”), intends to apply a portion of the MCC Funding to eligible payments under a contract for which this Invitation for Bids (“IFB”) is issued. Any payments made by the MCA Entity under the proposed contract will be subject, in all respects, to the terms and conditions of the Compact and related documents, including restrictions on the use and distribution of MCC Funding. No party other than the Government and the MCA Entity shall derive any rights from the Compact or have any claim to the proceeds of MCC Funding. The Compact and its related documents can be found on the MCC website (www.mcc.gov) and on the Equipe Technique de Formulation du Compact Régional (www.ucfbenin.bj).

  1. The Compact program consists of the following two (2) projects:
  • The Corridor Infrastructure Project (CI) which aims to reduce transportation costs along the transport corridor hat runs from Cotonou, Benin, Niamey, Niger;
  • The Efficient Corridor Operations Project (ECO) aims to reduce transportation costs along the transport corridor from Niamey, Niger to Cotonou, Benin including vehicle operating costs, time-related costs, injuries, and deaths as well as costs related to unreliable processes and market inefficiencies.

 

  1. MCC requires that all beneficiaries of MCC Funding, including the MCA Entity and any applicants, Bidders, Suppliers, contractors, Subcontractors, consultants, and sub-consultants under any MCC-funded contracts, observe the highest standards of ethics during the procurement and execution of such contracts. MCC’s Policy on Preventing, Detecting and Remediating Fraud and Corruption in MCC Operations (“MCC’s AFC Policy”) is applicable to all procurements and contracts involving MCC Funding and can be found on the MCC website at: https://www.mcc.gov/resources/doc/policy-fraud-and-corruption.

 

  1. This Request for Proposals follows the General Procurement Notice that appeared in the local newspaper, on Equipe Technique de Formulation du Compact Régional website, on dgMarket and UNDB Online websites on July 27, 2023.

 

  1. The MCA-Benin Regional invites duly constituted companies to submit offers for the acquisition of related goods and services:
    1. Lot 1: Supply and commissioning of a Deflectograph including related services (training, supervision of deflection measurement and maintenance)
    2. Lot 2: Supply and commissioning of one (1) Multifunction Roadway Monitoring Vehicle including related services (training, supervision of data collection and analysis, vehicle maintenance).

A bidder may submit an offer for one or both lots depending upon their capacity and resources available. However only complete bids meeting all requirements for each Lot is acceptable).

More details on these goods and related services are provided in Section V.Schedule of Requirements in the bidding document associated with this IFB (the “Bidding Document”).

 

  1. This IFB is open to all eligible Bidders who wish to respond. Subject to restrictions noted in the Bidding Document (BD), eligible entities may associate with other Bidders to enhance their capacity to successfully carry out the assignment.

 

  1. One or two suppliers will be selected under the Competitive Bidding (CB) procedures, the evaluation procedure for which is described in this Bidding Document, in accordance with the “MCC Program Procurement Guidelines,” which are provided on the MCC website (https://www.mcc.gov/resources/doc/program- procurement-guidelines).

 

  1. Suppliers interested in submitting an Offer must express their interests by completing the online registration form via the link https://forms.office.com/e/SY1YQerbrt .

This will guarantee their receipt of any communications regarding this Tender Document.

 

  1. Offers must be delivered electronically to the address and in the manner specified in the ITB 24.1 of the BDS no later than March 4, 2024, at 2:00 pm – UTC+01:00.

Only electronic offers submitted via the File Request Link (RFL) will be accepted. Late offers will not be accepted under any circumstances.

 

  1. The submission of Bid Security is:

Lot 1: 14 000 USD or in FCFA equivalent only.

Lot 2: 25 000 USD or in FCFA equivalent only.

These Bid Securities must be submitted in accordance with the provisions of clauses ITB 22.1, ITB 24.3 (c) and 24.3 (j) of the BDS, to the following address:
